Building Safety Act Update: JCT D&B 2024

We outline recent developments relating to the Building Safety Act, focusing on the Joint Contracts Tribunal (JCT) Design and Build Contract 2024.

Released on April 17th, 2024, the Joint Contracts Tribunal (JCT) unveiled its Design and Build Contract 2024, tailored for projects where the contractor handles both design and construction. This iteration marks an extensive update from the previous 2016 version, with significant amendments to accommodate the Building Safety Act 2022 legislation.

Key changes pertinent to the Building Safety Act within the JCT D&B 2024 include:

Incorporation of Part 2A of the Building Regulations 2010:

  • A new definition for ‘Building Regulations’ has been introduced.

  • The contract explicitly recognises the new dutyholder obligations under the Building Safety Act. Specifically, Article 7 addresses the appointment of the Building Regulations Principal Designer and Building Regulations Principal Contractor.

  • Article 6 now delineates the roles of Principal Designer and Principal Contractor under the CDM 2015 Regulations.

  • Clause 2.7 now includes a requirement to provide building information under regulation 11A(4) of the Building Regulations.

  • New provisions related to compliance with additional duties have been added in clause 3.16.

  • The definition of ‘Insolvent’ now incorporates two new grounds in line with the Corporate Insolvency and Governance Act 2020 (CIGA).

One observation worth noting is that the 2024 contract does not include specific provisions tailored to address the complexities of the new regime for Higher-Risk Buildings.
