The Building Regulations place clear legal duties on Clients. They must make suitable arrangements for planning, managing and monitoring compliance, appoint competent dutyholders and take reasonable steps to satisfy themselves that those arrangements are working.

For many Clients, the challenge is not knowing that duties exist. It is knowing what good looks like, who should be doing what, what evidence is needed, and whether the project is on track before a gateway, tender, commencement or completion point exposes a problem.

Safer Sphere’s Building Regulations Client Advisor service gives Clients and their representatives independent, technically informed support in discharging these duties. We help turn legal requirements into clear project controls, decision records and assurance activity that can stand up to scrutiny.

Our role is to act in the Client’s interest: testing arrangements, identifying gaps, challenging assumptions and advising on the steps needed to reduce regulatory, commercial and programme risk.

More than client-side administration

A Project Manager, Client Agent or QS may be managing the project day to day, but Client duties under the Building Regulations require specialist understanding of the regulatory regime, dutyholder competence, building control procedures and, for higher-risk buildings, gateway and Golden Thread requirements.

We provide the technical and procedural oversight needed to check that duties are being addressed, records are being maintained and the right questions are being asked at the right stage.

This is particularly important where the appointment is driven by gateway risk, uncertainty around compliance, or the Client’s need to evidence that reasonable steps have been taken.

A process-only appointment may provide paperwork. It does not necessarily give the Client confidence that arrangements have been properly tested.

Clients are responsible for making suitable arrangements for the project and for ensuring competent dutyholders are appointed. These duties need to be managed, reviewed and evidenced throughout the project lifecycle.

Our support includes advising on Client duties, preparing the Building Regulations Client Brief, reviewing dutyholder appointments, assessing competence, checking programme risks, advising on Building Regulations application strategy and maintaining a clear record of Client duties fulfilled.

This gives the Client and their representatives better visibility of the compliance position and a stronger basis for decision-making.

It also helps reduce the risk of duties being assumed, missed or absorbed into general project management without the right level of specialist oversight.

Supporting PMs, Client Agents and client-side teams

Many Building Regulations Client Advisor appointments are introduced by Project Managers or Client Agents at RIBA Stage 2 or Stage 3. At this point, the Client may be aware of their duties but may not have the internal capability to manage them without specialist support.

Building safety compliance is not only a technical issue. It is also a governance issue.

Clients need to know how decisions were made, what advice was considered, what risks were identified and what actions were taken. Without that record, it can be difficult to demonstrate that duties have been properly managed.

We help establish and maintain the evidence needed to support Client decision-making, including records of competence assessments, dutyholder reviews, building safety milestones, Building Regulations application strategy and gateway-related actions.

This gives the Client a clearer and more defensible compliance position.

Support where appointments happen late

Not every appointment happens early.

In some cases, Safer Sphere is brought in at tender, contract stage or RIBA Stage 4 because the need for specialist Client Advisor support has not been addressed earlier. The appointment may be introduced by a Contractor, written into scope to manage compliance risk, or triggered by concern around approval, gateway readiness or project delivery.

At this stage, there may be limited opportunity to influence early strategy. That makes clear review and decisive action even more important.

Safer Sphere works quickly to establish the current position, identify gaps and advise on the steps needed to reduce risk before the project moves further into construction.

This may include reviewing programme risks, dutyholder competence, Building Regulations strategy, change control arrangements, construction control planning, gateway deliverables and Client authorisations.

Earlier engagement is always stronger, but late-stage appointment still benefits from independent technical review and clear action.

Support for higher-risk buildings

For higher-risk buildings, the Client’s duties sit within a more demanding regulatory process. The Client needs to understand not only their general Building Regulations duties, but also how gateway requirements, Golden Thread information, Change Control, Mandatory Occurrence Reporting, commencement, completion and occupation-related requirements affect the project.

Safer Sphere’s service is expanded to support these obligations.

We advise on building safety milestones, HRB procedures, responsibility matrices, existing building information, Gateway 2 and Gateway 3 readiness, Change Control Plans, Construction Control Plans, Mandatory Occurrence Reporting arrangements, Golden Thread strategy and occupation preparation.

We also support the Client with key notices, declarations and submissions, including commencement, start notice, completion notification, change of principal dutyholder notification and occupation-related requirements where applicable.

These requirements need to be understood early and managed throughout the project. Waiting until submission or completion can create avoidable delay, cost and regulatory pressure.

Our role helps the Client prepare properly, maintain control and reduce the risk of last-minute uncertainty.

Audit, monitoring and project assurance

A strong Client Advisor appointment should provide active assurance, not passive advice.

Safer Sphere supports the Client through regular reporting, monitoring meetings and staged audit activity aligned to the project’s progress.

This includes reviewing Principal Designer and Principal Contractor arrangements, auditing dutyholder performance, monitoring cooperation across the design team, reviewing construction and change control processes, and checking readiness before key gateway or submission points.

During construction, we support the Client by reviewing site and Principal Contractor arrangements, change control, Golden Thread continuity, completion information and final declarations.

This provides the Client with a clearer view of whether the project is being managed in line with Building Regulations duties and whether risks are being addressed at the right time.
